Appellee contends that court erred In holding probate court had no jurisdiction In foreclosure of mechanics Hen, and that court erred In Inferring thot probate court is not civil court ot general Iurlsdlctlon. The mechanics lien statute creates new rights unknown to common law, and owners of property either legal or equitable and those having Interest therein are necessary parties, and here the only party defendant Is the personal representative of the estate, who may properly be made defendant to answer to hit Interest, but Is not a necessary party in interest, since under the probate code, he merely has possession, pending administration, but not title, and title is vested In the heirs. The jurisdiction of the probate court is set fourth by statute, and foreclosure of mechanic's liens are not within such statute. The legislature by Sec. 43-705 has stated that such actions may be brought in the circuit or superior court, and the probate court has no jurisdiction, and Its proceedings herein were void.
